By accessing or using Vibe with AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
Vibe with AI is an AI-powered thumbnail generation platform that allows users to create, customize, and download thumbnail images for their content. The Service utilizes artificial intelligence technology to generate images based on user inputs and preferences.
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.
The Service offers the following subscription tiers:
Paid subscriptions are billed on a monthly recurring basis. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel your subscription.
We reserve the right to modify our pricing. Any price changes will be communicated to you at least 30 days in advance and will apply to your next billing cycle.
All payments are processed securely through Stripe. We do not store your complete credit card information on our servers.
You may cancel your subscription at any time through the Customer Portal accessible via your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. No refunds will be provided for partial months.
All payments are non-refundable. We encourage you to start with our Free Plan to test the Service before upgrading to a paid subscription.
In accordance with EU Directive 2011/83/EU, EU consumers are informed that by subscribing and immediately using the Service, they expressly agree to the immediate performance of the contract and acknowledge that they thereby lose their right of withdrawal. We recommend testing the Free Plan before purchasing a paid subscription.
You agree not to:
Subject to your compliance with these Terms and payment of applicable fees, you retain ownership of the thumbnails you generate using the Service. You are granted a worldwide, non-exclusive, royalty-free license to use, modify, and distribute the generated content for commercial and non-commercial purposes.
The Service, including its design, functionality, software, algorithms, and all related intellectual property rights, remain the exclusive property of Vibe with AI and its licensors.
You grant us a limited, worldwide, non-exclusive license to use content you upload to the Service solely for the purpose of providing and improving the Service.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable Portuguese data protection laws.
We strive to provide reliable service but cannot guarantee uninterrupted or error-free operation. We may perform scheduled maintenance that temporarily limits access to the Service.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBE WITH AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
This limitation does not affect any statutory rights that cannot be waived under Portuguese or EU law.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.
You agree to indemnify, defend, and hold harmless Vibe with AI and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party rights.
These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Portugal.

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
